How Intellectual Property Assets Affect Estate Taxes

Society is currently moving through a transition from a community whose wealth is based in tangible goods, such as the means of production, to a community whose true wealth lies in intangible forms of property. We are moving toward a period where knowledge and ideas are more valuable than physical objects. Intellectual property, such as patents, copyright, trademarks and even trade secrets are what drive many of this country’s booming sectors. With widespread internet access, the creation of intellectual property is no longer restricted to large corporations or wealthy people who can afford to develop such property. Any person can develop value through a copyright, a patentable invention or a trademark. As intellectual property continues to grow as a wealth creation tool, individuals will be faced with the challenge of determining the value of the property, and the effect that such property will have on estate taxes.

Estate taxes on intellectual property, especially those based on copyrights, can have a substantial effect. When determining a person’s estate for purposes of estate taxes, it is first necessary to determine one’s gross estate. A person’s gross estate includes probate property and other tangible and intangible assets, such as retirement accounts or joint property. The current exemption for estate taxes is $2 million and will remain at this level through 2008. The estate tax exemption amount will then increase to $3.5 million in 2009, and is currently scheduled to be repealed in 2010.

When valuing intellectual property for estate tax purposes, the taxable amount is generally accepted to be the fair market value of the intellectual property on the date of the creator’s death. For example, the fair market value of copyrights will generally be considered their income producing potential, discounted for net present value. A common method for determining a copyright’s fair market value is to determine the likely annual earnings for the intellectual property for a future period, often between 5 and 7 years. A multiple, often between 3 and 7 is then applied to that number for the current valuation. Much of the valuation analysis is largely subjective, so determining the accepted method with the lowest valuation is usually the best choice, at least in terms of estate tax purposes.

Often, the taxes on a valuable piece of intellectual property in a decedent’s estate will be more than the available liquid assets or cash on hand to pay the estate tax. This often results in the estate being forced to sell some of the property in the estate to pay for the estate tax. Alternatively, the Internal Revenue Code does allow for tax payment deferment. Internal Revenue Code § 6161 allows for the deferment of estate taxes for up to ten years with a reasonable cause showing. Reasonable cause has often been interpreted as being met with a showing that the estate is comprised of illiquid intellectual property. This deferment period can allow an estate to take its time in determining how to pay the estate taxes, without being forced to make a hasty decision to sell estate property. However, keep in mind that the estate does have to pay interest on the deferment amount, which is generally the short term federal rate, plus 3%. See, IRC § 6621(a)(2).

Much of society’s wealth lies in intangible intellectual property. When determining the amount of a decedent’s gross estate for tax purposes, it is necessary for the zealous advocate to choose the generally accepted valuation method that is most advantageous to the client. Valuation methods will vary by industry and type of intellectual property, be it copyright, trademark or patent. If you or your client’s estate is comprised largely of intellectual property, it may be necessary to contact an attorney experienced in intellectual property valuation and tax planning. Contacting the property advocate may save the estate a substantial amount in the form of taxes, allowing it to dispose of the rest of the property in accordance with the decedent’s wishes.

Affiliate Recruiting - Easy Systems For Setting Up Joint Ventures Part 3

Joint ventures are a profitable and powerful way to market a product, but affiliate networks are very profitable as well. Clickbank has 100,000 affiliates waiting for products to promote and sell, making it the ideal place to go if you have a product to sell. The system in place makes it easy for vendors with an account and a product to connect with affiliates and conduct highly effective affiliate recruiting.

Affiliates can sign on to sell a product without your having to pitch it to them or convince them to sell it. All of the sales made through affiliates are tracked and accessible through your control panel. It will even take care of the banking hassles that small businesses have to deal with when selling items. Clickbank processes the orders for the product and approves the customers’ payment. It also takes care of the bank inquiries that may be necessary, as well as questions from customers.

Opening an account with Clickbank is free, but there are other fees. Contact information must be given to the site by the vendor so that checks can be sent from Clickbank. When the time comes to sell a product, there is an activation fee required of $49.95. This is a one-time fee and opens the door to a lifetime of sales. When an item is sold, Clickbank also charges a fee based on the selling price. There is a $1 charge plus 1.5 percent of the sale. This is deducted directly from the sale and the vendor and the affiliate are sent the rest of the sales price.

When signing on to sell a product through Clickbank, you must specify the price that will be charged for your product. Then, decide what your commission rate for affiliates will be, with the maximum amount of commission allowed being 75 percent. Clickbank will then show the vendor a page where potential customers can find out how to purchase the product. A customer will click on an order link to buy the product, and is then shown a window with the price. Customers enter their credit card information which must be approved by Clickbank before the sale goes through. Upon approval, the commission is deducted from the price and sent to the affiliate and the rest of the price, minus Clickbank’s fees, is sent to the vendor. The entire system is automated and the vendor has to do very little besides signing up and deciding a price and commission rate. Affiliate recruitment efforts are now underway in a highly automated fashion. The rest of the time may be spent looking for profitable joint venture partners.

There are more than 10,000 web businesses using Clickbank for its ease and effectiveness, which draws more affiliates than any other site of its kind. Clickbank works only with digital products, such as software and ebooks. These are items that are simple to sell online and don’t need a complicated shipping process.

And by using Clickbank to set up your joint ventures, potential partners know that with the automated system they will be paid their commission as agreed. This takes a great deal of the risk out of a joint venture enterprise and may help garner the trust of potential partners. The sheer number of affiliates and potential partners also means that there is a very good chance that some of them will have products similar to your niche item, no matter how specialized it may be. Make sure to find a partner with a very similar item to use their customer list to its full advantage.

One downside to the Clickbank affiliate system is that you do not personally choose your affiliates. Affiliates are free to sign up with products they want to promote, so your influence is minimal. But, vendors do choose their joint venture partners, which gives an element of control over the businesses that will be endorsing your product. Joint ventures tend to be slightly more personal deals, with more interaction between the vendor and the partner than a vendor with an affiliate.

With joint ventures, getting your product out in the virtual marketplace and in front of interested customers has never been easier. Affiliate networks and joint ventures have the potential to help your business earn a steadily growing income with much less effort on your part. Your affiliate recruiting process is now in large part on autopilot.

We All Are One - Is There A Comeback

“We all are one, we are the same person…” wrote Bob Marley, world-renowned reggae singer. But that was nearly thirty years ago, and what exactly has changed? What happened to that profound message of standing in unity and recognizing that we’re all human beings with similar needs, feelings, and aspirations?

Very few would argue that all of humanity is connected, and what is happening to one, is happening to another. Globalization has made sure of that. Through the variety of media outlets, we applaud courage, embrace integrity, and defend those who cannot defend themselves. We are the same person — our achievements, our dreams, our triumphs, are all of ours to share together. We participate in gatherings of all kinds to benefit from the progress that prospers us all. However, when do we stop to notice and change the opposite?

The pernicious doings of others is also our shame and tragedy. As a whole, what we do, or don’t do, contributes to the negative realities around us. I watch people criticize and point their finger away from themselves and onto others. I shed tears as I watch a world of people contaminate consciousness by excluding, separating, or destroying. Why do we run into the arms of pretense that bad things and bad people are someone else’s problem? I often wonder what has happened to this concept that we are all one.

Then on February 21, 2007, I watched the amazing alliance between Oprah Winfrey, famed talk show host, and guest Bill O’Reilly, the controversial, do-gooder host of the O’Reilly Factor. They joined forces and media power to go after child molesters and predators with a focus on a piece of legislation called “Jessica’s Law” in honor of Jessica Lunsford, a 9-year old Florida rape and murder victim. What struck me about the alliance was not only the fact that we needed to band together against these evil predators, but Oprah’s final words of acknowledgment that these victimized children were OUR children. She did not separate those children as victims of someone else, children of someone else, but OUR children, and she was right. I felt my spirit come alive with the utterance of a universal truth.

We need to build on that type of expansive thinking. We need to recognize that everything we do in our lifetime contributes to all those we encounter. And all those we encounter influence all those they encounter, and it goes on and on. Everything we do affects us together. If we do nothing, and only focus on our immediate realities, we are contributing and giving permission for others to indulge in all that is negative. Individually, each of us can make a difference.

We are far too connected to escape responsibility. As we have begun to embrace the concept of “shifting consciousness” to enact all that can ever be good for us by shifting from negative to positive; we must also expand our consciousness by shifting it toward responsibility to others. We have the power to positively change a world that is dishonest, cruel, and unjust, if only by shifting consciousness.

TODAY’S SPIRIT urges that we live in spirit and access the power that imagines anything is possible. Shift you consciousness away from “me”, and into “ours” to include everyone. We have to do it. We need to get a sense that our community is a world community that is free of exclusion. That is the evolutionary path we are taking to better the world. Every time you dare to imagine a world that is ours together, those thoughts will contribute to evolutionary impulses that will eventually change the world. The results will not be mine, or yours, but ours. This is the sole reason we should remember that we all are one.

Success in losing weight is a mindset and until that fact is realized, people will always end up on yo-yo diets and be disillusioned by the next weight loss product that hits the market.

You need to set your own weight loss goals and stick to them. You need a person on your team who forces you to be accountable. You are your worst enemy to your weight loss success. Discipline is fair game and weight loss success can be achieved if you make that extra effort to avoid certain foods, stop watching those late night pizza commercials and don’t be swayed in your decision to lead a healthy lifestyle.

Remember that someone selling you a weight loss product does not necessarily mean that they have tried the product themselves to validate the results. Selling weight loss products is a big business and you will become a sucker each time you fail our weight loss diet. Don’t be hard on yourself if you fail. It is quite normal to do so. However, if you can find the strength and determination to try again, there is a likelihood that you will succeed.

Evaluate where you are right now and how much weight you want to lose. Be sure to research any product that promises too much. Investigate the company, look for testimonials from those selling and buyers as well and make sure you read the ingredients or ask for them before you buy. Be responsible and be careful in your decisions. Set realistic goals and you will achieve good results.

How To Maximize Your Fitness Results (Accidental Exercise)

What I am about to reveal to you can make a drastic change in the out come of your fitness results. Many of us are willing to dedicate a decent number of hours each and every week to our workout plan. But quite often we do not always see the results we had hoped for. Looking at the big picture, the average fitness enthusiast only has about 3 to 6 hour per week to dedicate to their workouts. In a 168 hour week 3 to 6 hours is not really a large number of hours. We can drastically increase the number of hour we are exercising by practicing what is called multitasking. In the fitness industry combining exercise with your daily tasks is referred to as Accidental Exercise.

This type of exercise is great for those people who are very limited with their time. How many times have you waited for an elevator when you could have taken the stairs, or drove around a parking lot searching for the closest spot to the door so you would not have to walk very far? I think you get the point. Implementing more accidental exercise into your daily routine can make drastic changes in your fitness results.

Here are some other accidental exercise ideas that you can implement into your day:

□ Shovel snow

□ Sweep the driveway

□ Mow the lawn - Push Mower

□ Rake leaves

□ Talk the long way - walking

□ Take the stairs

□ Park your car far from the door

□ Walk to don’t drive

□ Stand don’t sit

□ Work in your garden

The accidental exercises listed above will help you burn a tremendous amount of additional calories throughout the course of a day. In this day and age technology is a major burden on our ability to burn additional calories through accidental exercise. If you were to think back when we didn’t have garage door openers, TV remote controls, microwave ovens and leaf blowers, we had do perform all of these activities manually. These accidental exercise activities that were a part of everyone’s daily lives helped us burn hundreds of extra calories each day.

Not only is accidental exercising a great way to help reduce body fat but in many cases it will improve areas such as muscle strength (including heart strength), lung strength, joint mobility, blood flow, injury prevention, brain function and self esteem.

In conclusion we now know that we can make some small changes in our daily routines that can result in some big changes in our health. It is recommended that everyone involve themselves in some type of exercise program coupled with accidental exercise activities. Why Worry?

“Worry a little bit every day and in a lifetime you will lose a couple of years. If something is wrong, fix it if you can. But train yourself not to worry. Worry never fixes anything.” by Mary Hemingway

Do you use this phrase, “I’m worried about …”? It’s such a commonly used expression that we say it unconsciously. Big or small, we worry about it all! What’s the result of all this worry? STRESS! Worry leads to more negative thoughts which lead to stress and then the stress leads to more worry. It’s a vicious circle.

So what can you do? Here are some steps to eliminate worry. First, define the worry with this question - “What am I worried about?” Be as specific as possible. Defining the worry helps you see what’s next. Second, investigate by asking -“Can I do something about it?” If the answer is “yes”, then ask - “What can I do and when can I do it?” If the answer is “no”, then ask - “How does worrying about (insert your worry) make my life better?” 99.9% of the time, your answer to this question will be “It doesn’t!” Third, resolve by either taking action or letting it go. If you can take some specific action to resolve the worry, then do so immediately. If what you are worried about is beyond your control, then make the decision to let it go now.

Let’s look at a personal example. At the beginning of the month, I start to worry about the two newsletters I write each month. With the worry come the thoughts, “What if I can’t come up with any ideas?” and “What if I run out of time?” Of course, all this worry leads to self-induced stress which causes me to head for the chocolate! And eating the chocolate brings about another set of worries! So what can I do? Using the above model, here’s what I can do instead:

Define
Question: What am I worried about?
Answer: I’m worried about not having new material for my newsletters.

Investigate
Question: Can I do something about it?
Answer: Yes.
Question: What can I do and when can I do it?
Answer: I can scan through my research materials and my favorite books and I can set aside a couple of hours this week to do it.

Resolve
Take action: I immediately block out time on my calendar to devote to researching topics. (Worry gone!)

What are you worrying about right now? Go through this quick exercise and see what happens. What do you have to lose? Worry! Paraphrasing from one of my favorite quotations from Dr. Wayne Dyer, “If you can do something about it, then why worry? If you can’t do something about it, then why worry?” In other words, why worry at all?

Or as the fictional character, Alfred E. Neuman (Mad Magazine), would say - “What, me worry?”
