With some of the interviews running over multiple hours and sessions sustenance is a major issue as well. How can you be enthusiastic, attentive and energetic after 3 hours of one-on-one interviewing and 2 hours of group interviewing and more to come? The mind and body work together in tandem, if one is overworked and exhausted it affects the other. Here are some tips to help you get through that long important day:

  • The Mind To feed our mind for a energetic day spend a few minutes (preferably 15 minutes to half-an-hour) in the morning of the interview on meditation or simple deep breathing and focusing on positive thoughts - you are helping yourself clear your thoughts and bring oxygen to your brain. And immediate effect would be a collected thought process, stress-release and instant peace! Also give a few minutes to stretch to let go off the body tension. Stretch before the interview and stretch during breaks.

  • Eating before the Interview Do not eat a heavy lunch or breakfast before the interview. It can make you sleepy and sluggish. The perfect balance would be a good balanced meal containing light carbs, salad, fruits and yogurt.

    Keep in your bag a banana or a protein / snack bar and a pack or juice and water. To keep your sugar leveled and keep you pumped up, you must eat at regular intervals. A few minutes of half an hour break that you get between the interviews is good time to snack. A rumbling tummy can be awfully embarrassing so even though your body is not giving you an indication it is better to act before it does!

    Also don’t have any garlic or other eatables which might make your breath smelly.

  • Let it go! If you feel you have said or done something during the interview which you would rather had not, just let it go. Thinking about it will only let you down and shake your confidence. Focus on the positive. Focus on your strengths.

Though cliche, the old saying couldn’t be more true. Practice really does make perfect…or as close to perfect and one can get. Though many new musicians can be discouraged when hours of practice don’t seem to make any difference as far as getting better, sticking to your instrument practice regime well eventually begin to pay off. So what are the best ways to learn and practice your instrument?

With so many concepts and techniques to learn such as scales, chords, arpeggios, rhythms, strumming, picking, finger style, bending, and slides (just to name a few), it’s only natural to have both option anxiety and progress anxiety. It’s hard enough to stay focused enough to learn, absorb, and assimilate a particular concept without continually questioning whether the manner in which you are learning is actually working.

For me, the most effective way to deal with these types of anxieties is to get back to why you are learning the instrument in the first place: the music. When I say “the music”, I mean the comfortable execution of a musical idea. It can be a song, a melody, a riff, a lick, part of a solo, a one-bar phrase, or any other things you can play that feels good and objectively sounds good. When a musical idea fits these criteria, it takes on the characteristics of what I like to call a groove.

A great source for these kinds of grooves is the increasing number of play-along book and CDs that are now available. A recent arrival on the scene, play along packages come with the sheet music, including guitar sheet music and piano sheet music just to name a couple, (and guitar scales and tablature if applicable) of songs from your favorite bands and artists, and a matching CD that has a live band playing these songs minus your part. So you’re the one who completes the music by “playing along”. There is no better way to improve your playing and comfort with an instrument than by playing in a band, and this is the next best thing (plus you don’t have to worry about waking up the neighbors). Imagine being able to play along with Stevie Wonder’s greatest hits or to jam with Van Halen?

Play-along music books are available for a lot of different instruments, the most common being:

  • Piano/Vocal/Guitar Play-Along
  • Bass Play-Along
  • Drum Play-Along
  • Jazz Play-Along for Bb, Eb and C instruments
  • Violin Play-Along
  • De Haske Play-Along for band & orchestral instruments

As you go through the process of learning a part and playing along with the accompaniment, try to keep a few things in mind:

  • Don’t set any kind of timeframe for how much practice it will take to lock in your part. Just concentrate on getting the timing down, and then the feel of the music. Try to feel secure in the notion that it definitely will happen, instead of always wondering when it will happen.
  • One tell-tale sign that you’re locking in your part is that you will naturally start to use an economy of motion to execute the idea. If you ever watch any of your favorite players closely, you can see that it usually requires very little movement to execute the ideas they play.
  • This type of practicing can also be helpful if you are learning a larger body of music. For example, if you’re learning a long solo, it’s good to break it up into several smaller digestible parts, to practice each piece in the above fashion, and to then put the practiced pieces together and play them in sequence.

As simple as the above exercise is, it can often be hard to execute, especially for beginning and intermediate players. The emphasis always seems to be on learning more, instead of spending time honing what you already know. For a long time, I was guilty of this, knowing how to play full songs and solos note-for-note, but not playing any of it well, or in a satisfying way either to myself or to a listener. It’s like you’re giving a speech in which you’re reading directly off the paper, instead of spending time learning how to pace the sentences and where to throw in certain inflections to make the subject matter more interesting and convincing.

To use another metaphor, the concept of honing or locking in a particular groove is akin to cross-training for an athlete, in that you are subconsciously and simultaneously working on the building blocks that constitute good musicianship, instead of tackling them one at a time. In particular, it helps you develop good “time”, which is a steady and even rhythmic component that all good players possess, and good technique, which is the smooth and easy execution of the particular groove.

Similarly, the honing of a groove is what all musicians go through when they join a band. In this case, the number of people trying to lock in the groove is equal to the number of musicians in the band. When everyone in the band has it locked in, the band has become what is often referred to as tight, with good time and well-executed parts.

So if you find yourself feeling the same kind of frustration I’ve outlined here, try getting back to the essence of playing an instrument - the music itself, and use the given exercise to facilitate this. In the long run, you’ll be happier, and you’ll be continually reminded of why you ever decided to start playing music.

Claims Against Keepers Of Animals For Their Animals’ Actions: Strict Liability Or Not?

The circumstances in which the keeper of an animal is liable for damage caused by his animal depend upon the category to which the animal belongs: animals are either dangerous or non dangerous. Section 2(1) of the Animals Act 1971 imposes upon the keeper of an animal of a ‘dangerous species’ strict liability for any damage caused by the animal. Non dangerous species do not have a regime of strict liability imposed upon them unless: (a) the damage is of a kind which the animal, unless restrained, was likely to cause or which, if caused by the animal, was likely to be severe; and (b) the likelihood of the damage or of its being severe was due to characteristics of the animal which are not normally found in animals of the same species or are not normally so found except at particular times or in particular circumstances; and (c) those characteristics were known to that keeper. These conditions are expressed in the conjunctive rather than the alternative which means that all three conditions must be met.

A. Type of damage

Subsection 2(2)(a) provides that the damage must be of a kind which the animal, unless restrained, was likely to cause or which, if caused by the animal, was likely to be severe.
In Mirvahedy v Henley [2003] UKHL 16 Lord Nicholls gave the example of a large and heavy domestic animal such as a mature cow where section 2(2)(b) may not be satisfied. He said that: “There is a real risk that if a cow happens to stumble and fall on someone any damage suffered will be severe. This would satisfy requirement (a). But a cow’s dangerousness in this regard may not fall within requirement (b). This dangerousness is due to a characteristic normally found in all cows at all times. The dangerousness results from their very size and weight. It is not due to a characteristic not normally found in cows ‘except at particular times or in particular circumstances’”.

B. Abnormal characteristics

Section 2(2)(b) of the Animals Act has been determined by the House of Lords in Mirvahedy v Henley in a split decision. Section 2(2)(b) relates to the likelihood of the damage or of its being severe was due to characteristics of the animal which are not normally found in animals of the same species or are not normally so found except at particular times or in particular circumstances. Lord Nicholls, giving the leading majority judgment noted that this subsection aimed to create strict liability for abnormal conduct of non dangerous species. The first limb of paragraph (b) identifies one class. The animal must have characteristics ‘which are not normally found in animals of the same species’. The second limb of paragraph (b) identifies the other class of qualifying characteristics. The animal must have characteristics which are not normally found in animals of the same species ‘except at particular times or in particular circumstances’.

The phraseology of section 2(2)(b) is notable for its capacity to be interpreted in diametrically opposite ways. There is no problem with the first part of section 2(2)(b)-do animals normally or are they prone to, for example, bite or kick? The problem is with the second part: does one cancel the double negative ‘not normally…except’ and ask whether what was done in the special circumstances was normal behaviour for the species as a general rule; or is the right approach to ask whether what was done was normal for the species in the particular circumstances even if it will be abnormal in the absence of such circumstances. In Cummings v Granger [1977] QB 397, the first of these approaches was adopted where Lord Denning MR said: “Those characteristics-barking and running around to guard its territory-are not normally found in Alsatian dogs except in circumstances where they are used as guard dogs. Those circumstances are ‘particular circumstances’ within section 2(2)(b). It was due to those circumstances that the damage was likely to be severe if an intruder did enter on its territory.” This approach was followed by the majority in Mirvahedy v Henley (see also Curtis v Betts [1990] 1 WLR 459).

How the majority interpretation works in practice is that a bitch with her litter, a guard dog, a cow with her calf, will be covered by section 2(2): in essence normal behaviour in specific circumstances. In Livingstone v Armstrong (11/12/2003)(unreported) it was found that there was no negligence on the part of the cow’s keeper in maintaining the fences on his farm. It was further found that the cow had in fact jumped a properly maintained fence. Evidence from the cow’s keeper was that it was not normal for cows to jump over fences. There was no evidence that the cow was frightened or that it had bolted. The claim failed on the basis therefore that section 2(2)(b) had not been met because the behaviour in the particular circumstance was not normal. The problem becomes, of course, that every situation becomes a ‘particular circumstance’ and that animals, being animals, have behaved in a normal way. In litigation of this kind it is extremely important to identify the special circumstance in order to establish the normal behaviour of the animal.

Conclusion

The Animals Act is minefield of potential interpretive errors. Mirvahedy was thought to be a low point for defendants but there is more potential for hope or despair in the judgment (depending on whether you are a claimant or a defendant) than appears on first sight to be the case.

  7. Create your own play-alongs by recording the changes to your favorite songs in a way that the metronome can be heard clearly along with the chord changes.

Be creative when you practice with a metronome. Remember, practice within the comfort range of your abilities but also use the metronome to practice extremely slow and fast passages. Everyone will experience at least one performance in their lives where they just felt like tempo was a real problem for them. Maybe you will rush the rhythm section or drag the beat. Practice the extremes so that when you are in live performance you will be prepared for absolutely anything!

It is estimated that some 10 million homeowners closed on what the mortgage industry refers to as a subprime mortgage in the last few years, a mortgage where the homeowner paid a higher interest rate because of lower credit scores, the inability to document income, or both.
