Whilst watching the news on a local Phoenix TV Station recently, I came across a human interest story about a couple who were in danger of losing their Phoenix home as they could not afford the payments. In this case, the homeowners had an interest rate of 9%, we will get to that later, and the mortgage broker who had arranged the loan in the first place had told them that would refinance after a few months in order to get lower monthly payments.

Firstly, they did not have great credit, plus they had no down-payment, hence the aforementioned interest rate. Also, given those circumstances, they were gambling that home prices in the Valley of the Sun would go up, of course they didn’t, which would enable them to refinance with a better loan-to-value ratio, they couldn’t. The fact is, they could not really afford the payments in the first place, and were using their meager savings to supplement them until re-financing. It was a house of cards, and it all came tumbling down. Yes, it is sad, but also quite predictable. If you are paying 9% in a 6% world something is not right. If you cannot afford the initial payments don’t take the loan. Do not take an adjustable rate loan with a low teaser start rate if you know you will not be able to afford the payments when the honeymoon period is over. Do not gamble that your home will increase in value in the next 6-12 months. You don’t know! Nobody knows. Some, but not all, lenders are quite willing, and ethically-challenged enough, to tell you anything you want to hear, in order to get you to sign on the dotted line. This is not an Arizona specific problem, it could happen anywhere.

The second case involved a gentleman in California who re-financed his home in order to finance his home-based used car business. The lender failed to supply, as required by California law, the loan documents translated into the language used predominantly in the negotiation. The borrower claimed he was duped, however he did admit an English speaking friend had read and translated the terms of the loan to him. Now he could not afford the payments and was looking to lay off the blame. In this case, I know for a fact that in order to be a car dealer in California, you must (amongst other requirements) have a storage facility for at least four cars, not at your residence. It must be completely separate. My point is, in this case, the borrower was quite willing, and ably abetted by the lender, to circumvent the rules while it suited his agenda. When he could not make the payments, he cried foul.

In both these cases, the borrowers played a little loose with the rules, or ignored early warning signs in pursuit of their goals. The will both certainly pay a price in the future because of bad credit, late payments and maybe even foreclosures.

Studies have shown that many times ethnic minorities end up paying more for their home loans than other folks. What the P.C. police do not tell you is that in most of those cases the victims were taken advantage of by people of the same ethnicity, that is to say unscrupulous people taking advantage of their own. In the end we are responsible for our actions, but remember everything must be in writing. If the broker “said”, then have him put it in writing. If he won’t, well you know the rest.

A beach with everything… Las Salines is one of the most popular and well known beaches on Ibiza. Resting at the southern most point of the Isle, Salines (as it is commonly known) is accessible by car, motorbike/scooter, by buses that run regularly in the warmer months (taking no more then an hour from Ibiza Town) and is a good ride on a bike as the road is bicycle friendly. The basic equipment needed is simple and inexpensive:

Bath or shower enclosure, non-slip mat for dog to stand on, several old towels or special dog towels if you like! dog or baby shampoo (it needs to be mild so that it doesn’t damage the coat), conditioner (optional but again this needs to be gentle and tearless), hair brushes and combs suitable for your dog’s type of coat, flea comb, grooming scissors (to be used with great care!), rubber grooming mitt, flea/tick treatments if necessary.

It’s a good idea to ensure that your dog has had a good walk before you set about grooming him. He will be much more co-operative if he has burnt off some energy before you expect him to lie still for a brushing. Prepare well by getting all your grooming equipment ready before you start and prepare to get wet - so make sure you aren’t wearing your best clothes!

Get comfortable on the floor with your dog lying on a towel or dog bed and spend time brushing his coat. This is a job best done outside if the weather is suitable. The fist job is to run your hands through your dog’s coat to check for parasites, lumps or sores. This is also a good time to check your dog’s ears, paws and teeth - if you have any concerns or if any of these areas seem painful you may need to make an appointment for your dog to see the vet. Using a fine-toothed comb will help remove fleas. If you find any ticks, they can be removed by covering them in Vaseline (this suffocates them ) and leave them to drop off - don’t be tempted to pull them as this will result in the tick’s head being left behind and this can cause infection. Carefully remove twigs or other matter with a comb and use scissors if necessary. Next, prepare to brush his coat thoroughly. The purpose of brushing him is to remove all loose or shedding hair from his coat. Brushing will help keep your dog’s coat in good condition as it helps spread natural oils throughout the coat and encourages blood flow to the skin. Take your time over this job - enjoy it as this provides great bonding for you and your dog. Keep talking to your dog, use praise and treats and try to make this a fun and pleasant experience.

If your dog has any mats, you may need to cut them out as it is very difficult and sometimes impossible to brush through severe mats. Shaving or using clippers may be the only way to remove severe matting. However, this must be done extremely carefully so as not to cause injury to your dog - if you are not an experienced dog groomer, this job may be best left to the experts.

It is important to remove mats before your dog’s coat gets wet as the water will make the mats tighter and this could be painful for your dog as the mats pull his skin. Be careful with your dog’s skin and brush gently so that you don’t cause your dog unnecessary stress or pain by pulling tangles and knots out of his coat. Only once his coat has been thoroughly brushed is it time to wash him.

If you are doing this at home, the easiest thing to do is to use your bath. It is advisable to place a rubber mat in the bath to prevent your dog slipping and to ensure that your bath isn’t scratched or damaged by his nails. If you have a shower attachment, use this first to wet your dog. If not, fill your bath with luke-warm water (up to dog knee height), before you put him in the bath. Be sure that the water is not too hot as your dog’s skin is easily scalded - remember this should be a positive and fun experience, not an ordeal! Carefully lift your dog (place one arm under his middle and the other around his front legs) and place him in the water. Use a beaker or jug to thoroughly wet his coat - never spray water in his face as this can be distressing for dogs. A regular warm bath can help accelerate the shedding process and this in turn means less dog hair in the house and less housework for you.

Now apply the dog shampoo and work it into a foamy lather on his coat. Start from the head but try not to get shampoo in his eyes, make sure you give his entire coat a thorough soaping. Your dog will particularly enjoy this if you massage his skin at the same time. Next, rinse your dog thoroughly and don’t forget his belly! It’s really important that you rinse off all the shampoo, any left on the coat will cause dry skin and itching. Keep rinsing until the water runs clear. may need to change the water at this point or use a shower to remove all the shampoo. A fairly powerful shower over the bath is a good way of getting rid of all the shampoo and should provide an enjoyable skin massage for your dog. Now dry him thoroughly with a towel. It helps if he has a good shake before you take him out of the bath. Most dogs like to have a mad race around after a bath - again, if you want this to be a pleasant experience, let him do this - you might want to spread a few towels out before hand though!

Some dogs require drying with a hair dryer - this is a good idea if your dog is elderly or the weather is cold. Ensure that the hair dryer is not too hot and that you don’t hold it too close to your dog’s hair as it can easily burn his skin. Now is the time for one more going over his coat with a brush or comb to remove any more hair that has been loosened by the bath. Ensure that he has a warm, dry and insulated place or bed to lie down on - a dog with a damp coat left in the cold will be very uncomfortable and this can bring on or worsen conditions such as arthritis. All dogs should have their ears checked and cleaned regularly and caring for your pet’s ears should form a regular part of your grooming routine. You may wish to clean his ears with a warm, damp face cloth or some cotton wool after the bath - when cleaning, be careful not to probe too far into the ear.

These products can be administered at home and involve placing a few drops on the scruff of your dogs neck. It is a good idea to treat your house for fleas at the same time and your vet should be able to advise you on products.

“Well The Marriage Wasn’t Even Valid Your Honor” And Other Excuses By Mr. Blowhard

There is always that person that thinks they know some trick that will allow them to escape accountability. You know who I mean of course. We all know this person. He is the slick talking blowhard. We will call him Mr. Blowhard for the purposes of this article. Imagine Mr. Blowhard having to go through a divorce in which he will have to give half, of “his” hard earned property, to his wife. Mr. Blowhard will go to any length to avoid such a result.

It makes for an interesting case when Mr. Blowhard enters the divorce process. His combination of limited legal knowledge and willingness to misstate the facts can turn a divorce proceeding into quite a spectacle. This article shall focus on the circumstances of a void marriage and the likely thoughts that will cross his mind. Some husbands, with knowledge that the marriage is void, think they have some sort of a prenuptial agreement that will allow them to escape spousal support, attorney’s fees and property division when things turn bad. As an example, let’s use a situation in which the marriage is void because of a pre-existing foreign marriage or a foreign divorce that wasn’t quite completed.

One fine day, Mr. Blowhard and his girlfriend decide to get married in the United States. The girlfriend has not finalized her divorce in another country. Mr. Blowhard knows of the prior marriage or incomplete divorce, and assures his soon-to-be wife that everything will be alright. “This marriage is from a foreign country,” he says. “The government shall never know.” All the while Mr. Blowhard is snickering to himself because he knows this marriage is null and void and he will never have to pay spousal support or be faced with other obligations should things go awry.

Well, well, Mr. Blowhard, believe it or not, you are not the first ingenious legal scholar to concoct such a scheme. In fact, the California Courts have dealt with this issue as far back as 1982, in the Recknor decision. The Second District Court of Appeal held in this case that a husband that knows of a prior marriage, that nullifies the current marriage and that still holds himself out to be married, is estopped from denying the invalidity of the current marriage.

Suddenly a light goes on in Mr. Blowhard’s head. “Hold on,” says Mr. Blowhard. “I never even knew she was married.” Again, Mr. Blowhard has used his limited legal knowledge incorrectly. If Mr. Blowhard is able to show that he never knew of the prior marriage he still must divide his “quasi-marital” property equally. On this point, I’ll cut Mr. Blowhard a break because the treatises even state that the answer is not clearly defined by the California courts.

If Mr. Blowhard were to do his own research he would see that the California Courts have done everything they can to show that Mr. Blowhard still has to divide his community interest equally. If Mr. Blowhard proves that he had no knowledge of the prior existing marriage, he is a putative spouse. California Family Code § 2251 states that if one of the parties had not know of the invalidity of the marriage then that party is a putative spouse and the property acquired during the marriage, (quasi-marital property), shall be divided in accordance with Fam. C. § 2500. When you read §2500 it states that all property must be divided equally.

Feeling a bit disheartened, Mr. Blowhard? Let me put it to rest for you. In Marvin, the California Supreme Court considered the issue of the bad-faith spouse. The Court stated that even in cases of a bad-faith spouse, the Court should still award the “guilty” spouse half of the quasi-marital property. After all, if we were to define an “innocent” spouse as one that believed the marriage as being valid, then awarding the innocent spouse ½ of the property is not frustrating their expectations.

The Courts have been dealing with Mr. Blowhard types since the early days of English common law. For the most part, all the schemes have been tried and the Courts have developed remedies for them. This dynamic process of trial and error is what makes our legal system so special.

Home inspections are done after your offer has been accepted.
Generally, you make an offer contingent on the property passing
its home inspection. Basically, the home inspection is to protect
you and the seller in case there happens to be something wrong
with the house. It should give you a good idea of what you are
about to purchase, what problems you may encounter, and allow you
time to negotiate the sales contract with the new information that
you have gained about the house.

A thorough home inspection would include checking electrical,
plumbing, gas and water lines in addition to individual outlets,
light sockets and faucets. The foundation, roof, windows, siding,
attic or crawl space would be inspected. The air
conditioning/heat unit should be inspected. In other words, a
thorough overall inspection of the house should be done.

The home inspector will arrive with a home inspection checklist
or a home inspection worksheet. These detailed documents will
list every item that needs to be inspected. Go to Google and
type “free home inspection checklist” to see the extent of what
the home inspector will be looking at.

No house is perfect, so expect to have at least a few potential
problems uncovered by the inspector. Once the inspection has
been completed and you have reviewed the report, you need to
decide if any of the uncovered problems need to be fixed and by
whom. You can ask the seller to fix the problems — which the
seller may or may not do.

When negotiating with the seller, consider what type of market
you are in — has the market been slow? Are the houses sitting on
the market a long time? Or are there multiple offers on houses
within hours or days?

If the real estate market has been slow and the house has been on
the market for a while, you should be in a stronger position to
negotiate with the seller regarding the issues brought up by the
home inspection.

On the other hand, if the house has multiple offers, the seller
is in the stronger position. If you really want the house, think
carefully about your options before accepting it without the
seller fixing the problems. Is the problem bad enough that you
would want to pass up on the house all together? Or are they
problems that can be fixed relatively easily?

Think of your financial situation. For instance, if you are getting
a good deal on the house you are looking at, would it be
less expensive to replace the roof yourself on this house than to
lose the house to another buyer and possibly end up paying more
for a house that does not need a new roof?

An important aspect to remember, is that, as with all people you
may hire for a job, home inspectors come with a wide range of
qualifications. Ask your realtor for recommendations and then ask
the home inspector yourself about their qualifications, methods,
and approach. Ask to see the home inspection checklist the
inspector will use and ask how long the inspection will take. A
thorough inspection should take several hours or more to
complete.

Use the information in the inspection to make a sound, well-
grounded decision about the house you are planning to buy.
Whatever you do, don’t let your heart lead you to make a poor
decision when your head is telling you to look at the facts and
move along. The home inspection is just one more tool that will
help you find and purchase the home that is right for you.

Podcasting is the concept of distributing a media file by paid or free subscription by way of the Internet. Podcasting uses syndicated feeds and the podcast product is played on either personal computers or mobile devices. The term podcasting is a derivative of the media player iPod created and manufactured by Apple.

What makes podcasting different than various other digital audio formats is the fact that it can be automatically downloaded. To do podcasting, therefore, you’ll need software that is capable of reading feed formats such as the most common RSS (really simple syndication) or Atom.

While the ability to offer podcasting has been around for decades it some form or another, it didn’t begin to catch on as a public product until 2004. Internet marketing caused a wave of public interest in podcasting about that time and now it’s grown considerably. And just keeps on growing. Before the World Wide Web came into being in the 1982 Radio Computing Services (RCS) was the source of music and talk software for radio stations. It was in a digital format. Before the digital distribution went online, the midi format and Multicast Network distributed video and audio files. Mbone was a noted network, multicast, over the Web and used mostly by research institutes and school, although there were talk programs by audio. Around 1995 many jukeboxes and Web sites provided a selecting and sorting system for audio and music files, for announcements and for talk - all in digital format though with variations. A few online sites offer subscriptions to audio services.

When Napster launched, downloading music became massive. Doc Searls, a technology guru, columnist and blogger started to keep track of how popular podcasting was becoming on the Internet. He did this by tracking how many hits Google got for the term “podcast.” That day there were only 526. In October the first podcasting search engine launched, and this helped podcasters to communicate with each other. In that same month The New York Times ran an article about podcasting that indicated that podcasting was cropping up in the U.S., Canada, Sweden and Australia. USA Today wrote a how-to piece a few months later, giving readers instructions on how to send and receive podcasts, and also listed its Top Ten podcasting directories.

At the same time podcasting networks started to appear, putting podcasters and their Internet offerings together with each other, offer huge marketing possibilities. Now there are podmercials, which allow vendors to market their wares through podcasting. At least one podcasting production company now produces podcasts for its business clients. Podcasting has come into being for those who want to make a buck from audio products sold to the public or want to market their own products through podcasts.

A fifth or subsequent offense will result in 6 months to 5 years of jail time, fines of $600 to $2,000, a license revocation period of two to three years, and an OWI surcharge of $355.
