So ill ask you to try a different approach, quit paying attention to what your favorite pro is doing on TV, quit believing all the hype and get back to the basics! The key to catching more and bigger largemouth bass is not in buying that new flashy crankbait that your favorite pro is getting paid to promote. though having all the latest fishing gear is nice, its not the secret or the key to catching largemouth bass!

Like mentioned above, in this day and age many of us are jaded by all the hype that surrounds bass fishing, to many of us have lost sight of the big picture and are lost in a world of promotions and misinformation. We are being programed to believe that buying this or that will catch us more and bigger bass. Now don’t get me wrong, theres some good information out there, but for the most part the world of bass fishing has turned into a circus.

So by now you’ve probably figured out that the secret to catching huge bass is not some grand closely guarded secret, its actually quite simple and comes down to this, KISS “Keep It Simple Stupid!” Try to shy away from the hype and instead focus on the basics. Learn the Largemouth bass and learn him well. Spend more time educating yourself about the largemouth bass and less time educating yourself on what your favorite pro is fishing with and you will start catching bigger and better bass. You will also begin to realize that you don’t need all the latest fishing gear to catch them big bass. Id be willing to go up against any pro on my lake or river with nothing more than a bucket full of shiners and a few sharp hooks, let him throw all his fancy lures around and Im sure id come out ahead.

Catching more and bigger bass is not difficult nor is it something that needs to be complicated, for the vast majority of us we are out there to have fun and catch fish, thats hard to do when your paying more attention to that huge box of fishing lures, than actually hunting down and catching bass. Don’t get me wrong here, having a good selection of fishing gear is important, but all that gear is useless to you unless you know and are familiar with the basics. Unless you are familiar with the largemouth bass and how they act and react, how they live and feed, how they move and breed, without this knowledge you will find yourself in the same boat as so many other anglers, wondering why your not catching the big ones, wondering why your bass fishing efforts result to being average. Most of us get stuck in a rut like this because we are overlooking the basics, the fundamentals of bass fishing.

So thats it in a nutshell, you want to catch more and bigger bass? Get back to the basics of bass fishing, quit complicating things and most importantly don’t believe all the hype! Just because Joe Basser is using the new gypsy diver and catching fish on TV with it, doesn’t mean its worth your time or money.

I am sincere about this;

Id be willing to go up against any pro on my lake or river with nothing more than a bucket full of shiners and a few sharp hooks, let him throw all his fancy lures around and I’m sure id come out ahead.

So by all means, if any professional bass fisherman would like to take me up on the challenge, I’m game, lets go fishing!

The Weekend Golfer Warmup

As the new years is now upon us, the clubs come out of the closet and we head out for the course after months of not playing.

Most of the time, you just show up at the course, maybe hit a ball of two and a couple of putts. Then it’s off to the first tee for the equivalent of a cold start.

If you don’t get to play more than once or twice a week, you should do a little extra warming up. Starting the night before you play.

Here’s a good way to prepare yourself for your weekend round. If you have a Saturday tee time, on Friday evening when you get home from the office get out your driver and swing it for about 10 minutes or so.

Make some long swings with a good flowing tempo. This should be easy considering there will be no ball. The swings are intended to stretch muscles and give them some semblence of a golf swing move to sleep on.

When you get up the following morning, about two hours before your tee time, swing your driver for a few more minutes. Get your body used to doing what you will be asking of it.

Once you get to the course, you should try to hit about ten or so balls. Since golf wears out the average weekend player before the 18th hole is done, don’t overdo your warmup by hitting too many balls.

Just because the tour pros hit fifty or more balls as part of their warmup doesn’t mean that it will work for you. Instead, you should conserve as much energy as you can by tuning up your body the night before and well before you get to the course.

If you have been struggling on the back nine, your not choking. You have just exhausted your resources for the day. Try a new warmup strategy that focuses on conserving energy for the round and you will enjoy the last few holes a lot more.

How Do Paralegals Get Smart?

A paralegal is by nature bright and socially adept. She has mastered language skills, and can artfully feint and parry both verbally and in written form. He is a whiz at multi-tasking. Their deductive reasoning is unparalleled.

What makes paralegals so smart?

· Obviously, individuals can take credit where personal credit is due. Some legal assistants are gifted or quick learners. Others just plain work hard to achieve their goals, their noses to the grindstone.

· The second ingredient is higher education. Nobody ever got hurt by learning more.

Highly specialized training in the fields of law, science and medicine, mean even more years in school.

Depending on how far a paralegal wants to go in his career, he may be able to fly on his own coat tails through an associate’s degree, or two years of higher education. This is particularly true if classes focus specifically on paralegal training. Many two-year paralegal degrees require a number of hours “shadowing” a paralegal during work, and doing as many tasks as possible under the supervision of an attorney or paralegal. That actually combines bullets two and three, but let’s not get ahead of ourselves!

The last subpart is on-the-job experience. Once you’re to this point, you deserve a pat on the back. You’re hired! Now all you have to do is steadily improve your skills. How does a paralegal improve her skills? By rapt attention to the work of other paralegals, attention to details in general and the files assigned to her, and attending the needs of her assigned attorney. To stay current on changes in law and technology that affect her position as a paralegal, she attends seminars. In the midst of all that attention to attending, or is it attending to attention, he also joins paralegal associations and volunteers on committees.

We must not forget another way paralegals can be smart. Some of them get hired in various positions in a law office, get their degree either in person or by taking online classes, and with those “gets,” got smart as they worked their way into a great paralegal position. Do you want to “Get Smart?”

Obligations On An Employer Who Is Served With A Detachment Of Earnings Order

The Child Support Agency (’CSA’) is able to order what some of us remember as ‘Garnishee Orders’ against employers in order to siphon-off a percentage of an employee’s income for the purpose of collecting child maintenance. Such orders, in this area of law, are a creature of statute and are called ‘Detachment of Earnings Orders’ (’DEO’). Rather confusingly, DEO’s are not the same as the Third Party Debt Orders found in Part 72 of the Civil Procedure Rules. Nomenclature aside, the real difference that is to be found in the DEO is the way in which one applies to have them set aside. An appeal against a DEO’s lies to the magistrates’ court on circumscribed bases, the definition of which has led to costly, confusing, litigation.

The power to order a DEO

The CSA’s power to collect child maintenance arises from section 4 of the Child Support Act 1991 (’the Act’). In turn, the CSA’s power to order the employer to comply with a DEO arises from section 31 of the Act which allows the Secretary of State to may make an order against a ‘liable person’ to secure the payment of any amount due under a maintenance calculation. A deduction from earnings order may be made so as to secure the payment of arrears of child support maintenance payable under the calculation and/or amounts of child support maintenance which will become due under the calculation.

Penalties against an employer

It is a criminal offence for the employer not to comply. Section 32(8) of the Act provides that if an employer fails to comply with the requirements of a DEO he shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding level two on the standard scale (£500).

Circumscribed grounds of appeal

What then is the available remedy for the employee who has had his earnings slashed by virtue of a DEO? The possible grounds for appeal against a DEO are contained in Regulation 22 of the Child Support (Collection and Enforcement) Regulations 1992 (’the Regulations’) which provides that an appeal may be made only on one or both of the following grounds: (1) that the deduction from earnings order is ‘defective’; and/or (2) that the payments in question do not constitute earnings. In reality the second ground of appeal is rarely argued because a dispute as to what constitutes earnings usually only occurs where the liable person is self-employed.

Appealing against a DEO on the basis that it is ‘defective’, however, is becoming an increasingly common avenue of appeal. Unfortunately, the common misconception as to the meaning of ‘defective’ in the discrete world of CSA law is leading to expensive and unnecessary litigation. This situation is sadly often fuelled by the lack of awareness of this area of law in the magistrates’ court. This may go to the absurdity of the legislation providing that the appeal ought to lie to the magistrates’ court rather than any fault of those courts.

However, surprising as it may seem, a ‘defective’ DEO is not, for example, one which ought not to have been ordered because the child support maintenance was never owed; nor that the calculation is entirely wrong; nor that the person who is the subject of the DEO is not a liable person. This is made clear by section 32(6) of the Act which provides that a court hearing an appeal under subsection (5) the shall not question the maintenance calculation by reference to which the deduction from earnings order was made. One begins to wonder if the ‘right’ to appeal is an Orwellian term.

Finding the definition of ‘defective’ requires some hunting around because it is not contained in the Act. Instead it is contained in Regulation 8(1) of the Regulations which provides that: “defective” means . . . that it does not comply with the requirements of regulations 9 to 11 and such failure to comply has made it impracticable for the employer to comply with his obligations under the Act and these Regulations. The criteria in Regulations 9 - 11 are rather banal provisions pertaining to: the name and address of the liable person, the name of the employer at whom it is directed; where known, the liable person’s national insurance number; and the protected earnings proportion (no more than 40% of a liable person’s earnings may be deducted). However, even if sections 9 - 11 are wholly ignored Regulation 8 will not bite unless the failure has made it impracticable for the employer to comply (so long as there is no breach of the protected earnings proportion). In other words if any monies have been deducted successfully in any month by the CSA, the DEO cannot be said to be defective.

Other avenues of appeal

The best weapon against DEO’s does not lie by way of statutory appeal, but in fact by way of an appeal against the maintenance calculation itself which lies to the CSA Appeal Tribunal. The Tribunal has the power to question the all important calculation which in turn may lead to some success in challenging the DEO. Unfortunately, this is still a little known form of redress against the DEO.

Telemetry Monitor - What Does a Telemetry Monitor Do?

Before we provide you with an explanation as to what a telemetry monitor is, first we will look at what telemetry is. Telemetry is the study and measurement of the transmission of certain data being provided over certain mediums such as the telephone or computer networks and which play a major part in any telemetry system. Today the main applications that a telemetry monitor is used for is to monitor electrical power plants, to allow for remote meter reading, for gathering meteorological (weather) data, to manage logistics, for tracking both endangered land and marine species as well as for monitoring manned and unmanned space flights.

Often a telemetry monitor is used in order to observe the equipment which receives the data and measurements, and the person will often act as an assistant to whomever is actually collecting the data and measurements being received. This particular job requires a person who has good observation skills as well as having good note taking skills. Although you will find telemetry monitors in many different fields of work the title that they have will always be the same. However, the skills that they have and what they actually do in their job as telemetry monitor will vary quite a lot.

Say, for instance, you happen to be a telemetry monitor who works in a hospital. One responsibility you may have is as an assistant to the nursing staff and you would be there to observe the telemetry monitoring system that is in place. Normally, information would come in to you through the patient telemetry monitoring system, you would take note of what is happening, and notify the nursing staff of any changes that may be occurring to the patient. Also, in a nursing environment, the telemetry monitor will have additional duties to perform. In most cases. the telemetry monitoring carried out in a hospital relates to cardiac issues, so it may require a quick reaction or detailed observation on the part of the telemetry monitor.

Although telemetry is valuable it would not work if it wasn’t for the telemetry monitor. A good one is responsible for making sure that all the data that is received in does not go to waste. It is important that they are able to show attention to detail and that they are able to make decisions relating to the data received quickly. However, this will also depend on what field you are working in.

Florida Basketball Gator Fever Has Now Spread To the Mouth

There is an enormous trend or following of Florida Gator fans right in the Tampa Bay area. With two national titles and the current basketball team on a 16 game winning streak every Gator fan is getting into the act - so much so that Gator fever has now spread to the mouth they as part of the increasing size of The Gator Nation.

As a dental braces specialist for adults and children, I have seen an increase of Gator fever spread from license plates, hats and t-shirts to now into the mouth. The Gator Nation can be seen on orthodontic appliances to move teeth.

I have a very high tech braces practice where not only children, but adults can choose their favorite colors to place on their braces and many are choosing orange and blue. They also pick blue and orange colors for their plastic retainers (devices worn after the braces come off to hold or retain the teeth in place so they don’t move).

Many of my adult and child patients have been alternating orange and blue on each brace while others have all upper braces in orange and all the lowers in blue.

Patients can choose over 20 colors to mix and match to tie the wire that fastens to each brace with a colored rubber donut. Interestingly, it’s not the braces that move the teeth; it’s the wire that runs through each brace. When an orthodontist fastens the wire to the braces, the wire deflects. When the patient leaves their appointment, the deflected wire will return to its original shape carrying the tooth it’s attached to move with the wire.

There are now braces that come in interesting shapes called WildSmiles Braces and were invented by Orthodontist Clarke Stevens, DDS, in Nebraska who developed braces in the shaped like hearts, flowers, baseballs and stars.

The trend today is to have straight teeth so that children won’t be embarrassed by their crooked teeth, be accepted more by their classmates and be able to compete against other equally competent students to get accepted into college. University of Florida has incurred a tremendous increase in applications from families trying to enroll their children into a four year college education there … everyone wants to go to one of the most popular schools in the nation especially with all the publicity the school is getting from having both #1 football and basketball titles.

Two children with the same application, grades and extra curricular activities as music, sports and community service will also be judged when you get down to it by their appearance. Whether someone at the interview has a gorgeous white smile versus ugly crooked teeth I’m sorry to say will make a difference if the two applicants are the same.

Sideways Through Life

“We’ll meet our destiny head on.”

“Forward will we go into the brave new dawn of day.”

“Don’t dwell on what went wrong. Instead, focus on what to do next. Spend your energies on moving forward toward finding the answer.”

All of these, while excellent quotes from various people, have a singular item in common. They all talk about facing forward while going about life. All of them talk about a focus that shows us only a certain perspective, that of always looking straight ahead.

What would happen, if only for a few minutes a day, we actually turned sideways? Yes, physically sideways, with either shoulder pointing to the way we were going.

We would see some amazing things. I grant that most people are very familiar with their surroundings, so much so that they can point to a given object if asked where it is, without looking at it. (or at least very close to it) We are all aware of the color of the paint or wall paper in a given room or hallway. Even the books or nick-nacks on our desk or work area at work.

But what about the other people in the office, the scenery while riding in the vehicle? (please do not try to turn sideways while driving as it may cause accidents or other unwanted ill effects). What about the items on the shelf at the local store?

Turning sideways in life, while sounding foolish or funny, often produces some rather wonderful results. We notice things we may not have otherwise. We garner a fresh new idea from something that we had not thought of before.

Let’s go for a few examples of what we might see or learn while going through life sideways.

While in the office, and walking to the local printer/copier, we turned sideways and found ourselves staring into a co-workers cubicle or office. What a wonderful chance to give a quick and heartfelt greeting. From out of nowhere, we can try and brighten someones day by a quick and simple good morning. It might be just what they needed to refresh their morning. You never know.

While at the local store, we turn sideways while going down our favorite isle. Now, directly ahead of us is a new product design in an old favorite, maybe something like a fondue set. Purchasing it might mean having a party with friends or family, which we could share good times together. The item might well have gone unnoticed, and the creation of some very pleasant memories would have gone with it, had we not turned sideways.

While walking through the back yard or through the park, turning sideways offers us a view of an elegant flower blooming its heart out. there it is, in nature, showing us how simple life can be. From that sight, we take a fresh sense of self esteem and continue our walk, lost in thought about something else, but always remembering the flower we saw.

So, for all the work it might take to turn sideways in life once in awhile, it can offer us so many advantageous rewards. So go ahead and let people find humor in watching you turn sideways for a minute in life.
