Ok, you’re selling FSBO and you’ve found a buyer. Now what? A simple one page Purchase and Sale Agreement just won’t do. There are so many considerations to protect both the buyer and seller.

Consider property disclosures, lead paint forms, financing, septic inspection forms, well forms, condition of title forms, neighborhood review forms, etc.

You name it, there is a form for it.

You don’t want an unaddressed issue to come back and bite you after the sale, so protect yourself and get everybody involved in the transaction to sign and initial.

My first step in selling fsbo would be to have a local real estate agent give me copies of all the forms they use in the process of selling a home. Agents are well protected these days, and the real estate industry makes sure to cover everything possible to help insure a smooth transaction. Go over the forms and see if you are covered for the type of property that you are selling. You should get these forms well in advance, before finding a buyer. Some forms are County specific for your state.

When in doubt, consult a real estate attorney to review your Purchase and Sale Agreement.

While every form is important, the one form that needs your attention most is the “property disclosure form”. This is the form that discloses everything that you know about the propety. It is important so the new buyer can make an informed buying decision. You don’t want a buyer coming back to you after the purchase to make you pay for a problem that you were aware of, but didn’t disclose.

I have a close friend. He’s on his cell phone all the time, and yet he has the sort of relationship with it that one might have with a sworn enemy or an extremely bitter ex-spouse. He curses it, throws it, and often misplaces it just for spite. Its keypad is worn to nubs. It drops calls, has a battery life of up to several minutes, and can only occasionally receive (but never send) text messages. All in all, it’s one of the worst cell phones imaginable.

Why doesn’t he just get a new one? Because it’s not his to replace. His cell phone was bought and paid for by his employer, and he’s required to carry around this outdated device for his job. That might not be so bad by itself, even if the phone does look like it went out of style sometime during the Eisenhower administration — but, to add to his woes, he also uses it as his personal phone.

Convenience and Necessity

Many employers give out cell phones to their employees, in order to stay in contact and make work communication more flexible. As a result, many people who might not otherwise have a cell phone now find themselves in possession of one. At first glance, it’s hard to complain about a free phone — beyond the unwanted after-hours work call, of course. On the other hand, a work-sponsored phone can sometimes be a bit of a hassle if co-opted into personal use.

Consider the sad case my aforementioned friend, who has spent years making both work and personal calls on his cell phone. Not only does he hate his phone like fire, but, due to a change in his employer’s policies, he now has to go over his monthly bill and itemize it, separating the personal calls from the business calls. While few people want to be the guy walking down the street with a phone in each hand, barking into two handsets and blocking traffic, even fewer want to be up at two in the morning sweating over their wireless bill because they have to justify their airtime.

In such circumstances, wouldn’t it be easier just to get your own?

Options and Alternatives

Granted, you may be one of the lucky ones, whose employer not only pays for your phone, but gave you a nice, shiny new phone to boot, instead of merely the least expensive one they could find. Perhaps they don’t even mind if you make personal calls. If you are such a person, rejoice in your good fortune and think no more of it. On the other hand, if you’re more like my poor associate with his archaeological curiosity of a cell phone, you might want to consider springing for your own.

The advantages of having your own cell phone are innumerable: you’ll have your own number, which won’t change if you change jobs. You won’t suddenly find yourself without a cell phone if your employment situation changes. Most of all, you can pick a phone that’s right for you. Such a proposition doesn’t have to be expensive. If you have an intense dislike for obligation, many prepaid cell phone plans come with an inexpensive phone. If, on the other hand, you’re looking for something more long-term, many cell phone carriers offer more feature-rich phones with a new contract.

Granted, having two phones may seem a tad excessive at first. But think of the freedom. Think of that shiny new phone of your choosing, with a real camera and an mp3 player, resplendent in its decadent consumer-electronics goodness. Most of all, think of yourself, itemizing your bill and explaining that forty-minute chat with your friends upstate to your employer. That should motivate you.

It’s a commonly held belief that healthy people are more productive. Recent studies we’ve all heard of seem to overwhelmingly support that belief. Now, I’m no scientist, so I wouldn’t begin to question their findings, but, doesn’t it follow that productive people are more healthy? If so, we have in our hands an amazingly simple method to improve our own health, without insurance, government assistance or any other of the trappings thought of as necessary for good health. This article will focus on the flip side of productivity…how it enhances health.

Aging And Illness: We used to believe aging and illness were just our bodies wearing out over time. The older we get, the higher the chances of a fatal disease…right? Of course! The extreme training athletes undergo to push their bodies to the limit does wear them out, but this isn’t the case for the rest of us. For most people, aging and illness isn’t our bodies wearing out, but rusting out. It’s as if we left a pair of pliers out in the weather. Before long, they’d be unable to function. It’s the same for us! Just breathing creates a process in our bodies, called oxidation (rusting). Oxidation sets us up for a number of illnesses, cancer, being one of the better known ones. As the oxidation process continues, our bodies become less efficient at maintaining health, until we can’t function and are at risk for an increasing number of diseases. If wearing ourselves out were a concern, no doctor would recommend exercise for health. In fact, non-productivity speeds up the oxidation just like a pair of unused pliers.

Non-Productivity: While there are exceptions that can be found, it’s no accident that those who are less productive in society (rich and poor, alike) are the most unhealthy, often morbidly obese and invariably unhappy. I haven’t seen any studies of productivity and mental illness but there is no reason to assume there wouldn’t be just as strong a relationship as with physical illness. We’ll get into some of the physical mechanisms involved in a moment, but let’s finish with the issue of non-productivity. Everyone knows, if you don’t use your muscles, they become weaker. If you tied your arm up for a year or more, it’s possible you could never use it again. The same is true of mental abilities. Don’t exercise your mind and you’ll be gradually less able to use it. In fact, there’s an old saying based on this principle. “If you don’t use it, you lose it.” It’s so reliable a principle, you can find it in the Bible. while this article isn’t about spiritual health, both science and social wisdom agree with the Bible that productivity is required if we wish to continue functioning.

Productivity And Body Chemistry: Every body functions as a goal-striving, achieving mechanism. We were designed to do stuff! When we stop doing stuff, we break down. Early studies discovered a group of chemicals produced in our bodies whenever we engaged in sexual intercourse…endorphins. They are largely responsible for our drive to reproduce. These chemicals are better than anything at the pharmacy or on the street. They reduce stress, relax us, give us a euphoric feeling, make us happy and reduce pain. In fact, next time she says, “I have a headache.” tell her that’s why you were offering sex. There have been some amazing discoveries, recently, concerning these endorphins. We learned that physical exercise produces them. Then, we learned that any kind of productive physical activity produces them. People don’t sing because they’re happy…they’re happy because they sing. In fact, we’re learning that mental exercise and activity produces the same chemicals. Just reading a book or listening to music…doing something…produces endorphins. Over time, these endorphins are very effective at relieving many mental illnesses, including anxiety and depression. Just like our sex-drive, we were designed to be productive, achieving beings. Our physical health and our mental health depend on it.

Here it is…a shocking and simple method to maintain our own mental and physical health…be productive. Unless we’re suffering a severe mental or physical disability, we have control over our physical and mental well-being. Feeling down? Listen to music, whistle! Feeling anxious? Take a walk, mow the lawn! Don’t feel like exercising? Exercise and you’ll feel like it! Start slowly if you haven’t exercised. Try a 10 minute walk and gradually build up speed and distance. Eventually, we get to a tipping point, where we feel happy and fulfilled most of the time, and that happiness, believe it or not, produces endorphins. If you’ve been depressed, stressed or anxious, maybe even being medicated for it, how would it hurt for you to start an exercise program or take classes, do volunteer work or take up singing. You want to be healthy and happy? Step up your productivity! That’s what we were designed for.

Is Life An Accident? (Part 1 of 2)

“If life were an accident, why would we be here on Earth?” asks Jenna, age 6.

The “why” question is what separates humans from animals and other living things. Animals don’t ask “Why?” They don’t question their destiny or pose existential questions. Dogs don’t long to be cats. They instinctively chase cats, but never wonder why they do it.

“Why?” is reserved for human beings. Inside of us, there’s a longing for purpose, meaning and destiny. Without it, people turn to mush. Kill desire, and watch people languish in apathy and indifference. Psychiatrists make a good living from giving advice to hopeless people. If we’re just accidents spinning through the universe, why should we feel lost without a sense of purpose?

“There is a reason for everything!” says Whitney, 9. “God doesn’t make mistakes. We know God made us for a good reason. God loves you!”

What is it about movies like “Braveheart,” “Chariots of Fire” and “Gladiator” that stirs men’s hearts? Women flock to “The Princess Bride,” “Gone With the Wind” and “Sleepless in Seattle.” Why?

As author John Eldredge says in his book “Dare to Desire,” men long for a heroic battle, an adventure and a beauty to rescue. Women long “to be pursued and fought for, to be swept up in a great adventure, to be the beauty.

“In the long run, it doesn’t matter how well we perform or what we accomplish — a life without heart is not worth living,” Eldredge writes. “To lose heart is to lose everything.”

The Bible says God has placed eternity in our hearts (Ecclesiastes 3:11). People who listen to their hearts will hear the question “Why?” Those who are brave enough to follow this inner voice will seek the answer and find it in God.

Those who don’t listen to their hearts live contradictory lives. No one gets out of bed in the morning without some purpose for living.

“God created all things on purpose,” says Carlee, 7. “He wanted something to enjoy, and that thing is you and me.”

“The steps of a good man are ordered by the Lord, and He delights in his way,” wrote King David (Psalm 37:23). Yes, God created us for his good pleasure, but he also made us to enjoy fellowship with him.

The accidental worldview, which is the inevitable result of the evolution theory, can never satisfy a person’s deepest desires. Many who embrace this worldview cast off all restraints and live in hot pursuit of pleasure. Why not?

King David, the man after God’s own heart, had a radically different view of pleasure from the one we commonly see portrayed in the media. Speaking of God, he wrote: “You will show me the path of life; in your presence is fullness of joy; at your right hand are pleasures forevermore” (Psalm 16:11).

Pleasure with the right purpose confirms our reason for living and fulfills our deepest desires. People who live as atheistic hedonists settle for too little pleasure. God wants to take that deep cavern in our souls and fill it to the point where it overflows with joy, purpose and spirituality, which Jesus described as rivers of living water.

Think about this: “God created you for a good reason because he loves you,” says Aaron. “Just imagine when you are older, and you have only one son. Would you give him up for people who sin? God did that for us.”

Memorize this truth: Psalm 16:11 previously quoted.

Ask this question: Do you live with purpose?

It saddens me to see what we modern Christians think of as a leader. It’s as if someone disconnected our spiritual gifts and we’re unable to distinguish the leaders God chose from the ones man chooses. We tend to see their physical appearance, the political positions they take, the letters before or after their names, the titles on their resumes, and their ability to please everyone as the chief qualifications of a Christian leader. We’re surprised and upset when these people lead us over a cliff, even though we led ourselves there by using worldly standards to choose a Spiritual leader. This article is all about who God says we’re to follow and who’s responsibility it is to make sure we’re following the right leader.

The Title Means Nothing: We’ve all heard it! He’s a “this” or she’s a “that!” Title, education, political position, even looks are all meaningless. Oh, but what if he’s got a Doctor of Divinity degree? Meaningless! It isn’t that we should disrespect someone’s worldly accomplishments. It’s just that these have nothing to do with Spiritual leadership. One of the reasons Jesus, and later, Peter were ignored by the Jewish leaders was because of their lowly status as carpenter and fisherman. Here, we see a great example of worldly and Spiritual leadership. The chief priests wore flowing robes, had the best Scriptural training, were born in the best families. Everyone honored them, obeyed them and gave them preferential treatment. They made their living from the offerings given to God. In fact, many regarded them as gods. Yet, Jesus, truly God, was scorned, ridiculed and executed by the very people He came to save. The same is true of leadership today. We’ve all seen dedicated people of God who have little formal training, but decades of studying and living God’s Word. Yet they go totally ignored or worse, by Christians, simply because of their looks or speech or humble employment. If we’re to be followers of the one true God, we must be willing to hear Him when it comes to who He chooses as leaders. We must be discerning enough to use God’s Spirit in us to rule out the pretenders.

If They Don’t Say What They Do, Don’t Do What They Say: Pretenders are people who are perfectly willing to use position and manipulation to tell you exactly how to live, but don’t live that way, themselves. I once knew a pastor of a large Christian church who felt justified in accepting sexual favors from the wives of several church members, while ignoring his own wife. You never got a more compelling sermon than when he preached on sexual sin. This is an extreme example of what goes on in countless churches all over the world. More common is the pastor who preaches on loving Christian relationship but keeps a “professional” distance from the congregation. Yes, I knew a few of these…one left the church as fast as he could and lived as far as he could from the church, to avoid the people. Yes, listen to their words, but watch their hands and feet. Many of these people are in their positions because of their skill at spinning entertaining tales about the truths of life, but have no interest in those truths. They are the pretenders Jesus and Paul cautioned us about, false leaders who will say anything our itching ears want to hear, to lead us away from Christ.

From Fruitful Fellers Flow Fresh Fruit Followers: Jesus told us how to discover pretenders…by the nature of their fruit.. He said good apple trees won’t have thorns and thorn bushes can’t produce apples. Jesus told us to examine the fruits of someone’s ministry before we join it, yet how many of us do that? What is the character of the minister’s chief followers? How are the people maturing? Are there a lot of bad apples hanging around? Do you see evidence that the Holy Spirit is working in the live of people? Jesus put the responsibility squarely on our shoulders as to who we followed. If you’re being led over a cliff it isn’t the leader’s fault…it’s the follower.

Listen To Learn If The Leader Is Listening: Faithful followers listen to God, and check to see if the leader is hearing God, as well. Acts describes the Bereans as faithful because they checked the Scripture to see if the Apostles were telling them the truth. Paul gave an assignment to everyone who is not the speaker in church…to listen to what the speaker says. Why? Not so you will always do what the speaker says, but so you will always know if what he says is from God. The Bible says you need no one to teach you except the anointing of Holy Spirit which is within you. Your responsibility in church isn’t to follow in lock-step with the appointed ruler, but to question and challenge and investigate what the “leader” is saying. If any minister thinks you should take whatever he says as if it’s from God, he isn’t a minister assigned by God…he’s a pretender.

True leaders are those who live the love of God. You can see the matured fruits of the Spirit in their words and actions. If they find a conflict between the Word of God and what they see happening, they will try, out of love, to correct it, rather than find a political solution that leaves people in sin. True Christian leaders have fruitful followers who display maturity in Christ.
